Welcome to LUX ("we", "our", "us"), a software suite designed to connect buyers and sellers across the United States. By registering for, accessing, or using our suite of applications (the "Service"), you ("you", "your", "End-User") agree to be bound by these Terms of Use ("Terms") which include this End User License Agreement ("EULA"). Please read them carefully.

1. Acceptance of Terms

By registering for, accessing, or using any part of the Service, you agree to these Terms and this EULA. If you do not agree to all the terms and conditions of this Agreement, you must not access or use the Service.

2. Acknowledgement

This EULA is between you and LUX (the "Licensor"), and not between you and Apple Inc. ("Apple"). LUX, and not Apple, is solely responsible for the Licensed Application, its content, maintenance, support, and warranty. Nothing in this agreement conflicts with the Apple Media Services Terms and Conditions or Apple's Usage Rules.

3. Description of Service

  • Sellers can post product listings.
  • Buyers can message sellers and bookmark products for future reference.

4. User Eligibility

The Service is available only to individuals and businesses who are at least 18 years old and can form legally binding contracts under applicable law. The Service is not available to minors under 18.

5. User Accounts

  • Registration: You must provide accurate and complete information when creating an account.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • Account Termination: We may suspend or terminate your account immediately for any reason, including violation of these Terms.

6. License Grant & Scope of License

Subject to compliance with these Terms, LUX grants you a non-transferable, revocable license to use the application on Apple-branded devices you own or control, in accordance with Apple's Usage Rules. You may not distribute, rent, sublicense, or make the app available over a network except as permitted by Apple's rules.

7. Maintenance & Support

Apple has no obligation to provide maintenance or support services for the app. Any maintenance or support is provided solely by LUX.

8. Warranty Disclaimer

The app is provided "as is" and "as available," without warranty of any kind. LUX, not Apple, is responsible for addressing any warranty issues or refund obligations as required by applicable law.

9. Product Claims

You acknowledge that LUX, not Apple, is responsible for addressing any claims related to the app or its use, including product liability, regulatory compliance, and consumer protection claims.

10. Intellectual Property Rights

All rights, title, and interest in the app remain with LUX and its licensors. By posting content, you grant LUX a non-exclusive, worldwide, royalty-free license to use and distribute your content through the Service. LUX is responsible for handling any third-party IP infringement claims.

11. Prohibited Conduct

  • Use the Service for any illegal or prohibited purpose.
  • Harass, abuse, or harm others, or post unlawful or obscene content.
  • Attempt to gain unauthorized access to or impair any part of the Service.

12. Data Privacy & Security

  • Data Requests: You may request deletion of your data anytime at https://luxapp.biz/support/.
  • Data Security: Your data is stored on secure SQL servers following industry-standard practices.

13. Indemnification

You agree to indemnify and hold harmless LUX, its affiliates, officers, agents, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Limitation of Liability

LUX, not Apple, will not be liable for indirect, incidental, or consequential damages, including loss of profits, data, or goodwill resulting from use or inability to use the Service.

15. Modifications to Terms

LUX may modify these Terms at any time. Updated Terms will be posted on this page, and continued use of the Service constitutes acceptance.

16. Legal Compliance and Export Restrictions

You represent that you are not located in a country subject to U.S. embargo or on any U.S. Government restricted list.

17. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles.

18. Third-Party Terms

You must comply with all applicable third-party terms that apply when using the Service (e.g., payment providers, carriers).

19. Third-Party Beneficiary

Apple is a third-party beneficiary of this EULA and has the right to enforce it against you.
